Medical malpractice insurance is mandatory for all licensed healthcare providers and facilities in Kenya. It covers legal defence costs and compensation arising from: misdiagnosis or delayed diagnosis, surgical errors and procedural negligence, prescription drug errors, failure to obtain informed consent, and claims arising from treatment provided by employed and locum clinical staff. Operating a healthcare facility, clinic, or private practice without malpractice cover is a serious legal and financial risk — and increasingly required by the Kenya Medical Practitioners and Dentists Council and health regulators as a condition of licence renewal.
